Terms of Service

These terms form the agreement between you and Halum. They apply whenever you use https://www.halum.world, whether you are booking an experience, listing one, or distributing a partner link.

1. This agreement

Halum is operated by ou2there, of 5830 E 2nd St, Ste 7000 #22058, Casper, WY 82609, United States. In these terms, we and us mean that company, and you means the person using the site.

By creating an account, making a booking, or listing an experience, you accept these terms. If you do not accept them, do not use the service.

2. What Halum is, and what it is not

Halum is a marketplace. Independent tour operators (“vendors”) list experiences, and travellers book them through us. We provide the platform, take the payment, and pass the booking on.

We do not operate the tours. When you book, your contract for the experience itself is with the vendor, not with us. The vendor is responsible for running the tour as described, for its safety, for holding any licences or insurance the activity requires, and for meeting local law. We are responsible for the platform, the booking and payment process, and for dealing fairly with you if something goes wrong.

3. Eligibility and your account

  • You must be at least 18 years old to create an account or make a booking.
  • The information you give us must be accurate, and you must keep it up to date. Booking confirmations go to the email address you provide.
  • You are responsible for keeping your password secure and for activity under your account. Tell us promptly if you think someone else has access to it.
  • One person may not hold multiple accounts to work around booking or cancellation limits.

4. Bookings and payment

Prices are shown on each tour page in the currency the vendor has set, and the total is calculated on our servers from the tour price and the number of people. The price you see at checkout is the price you pay; we do not add hidden fees at the end.

  • Payment is taken by card through Stripe. Your card details go directly to Stripe and are never held by us.
  • Your booking is confirmed only once payment succeeds and you receive a confirmation email with a QR code. Selecting a time slot alone does not reserve it.
  • Some tours close bookings early. Vendors can set a cut-off a number of hours before the start time, after which the slot can no longer be booked.
  • Availability is finite. If a slot sells out while you are paying, we will not charge you, and any authorisation will be released.
  • Bring your booking QR code to the tour. The vendor may refuse entry if it cannot be verified.

5. Cancellations and refunds

Each tour sets its own cancellation policy, and that policy governs whether you get your money back. It is shown on the tour page before you book, and you should read it. Terms differ from one vendor to another.

  • Cancellation window. Most tours require you to cancel a set number of hours before the start time. You can cancel from your bookings page up to that point. After it passes, the site will not let you cancel and you will need to contact the vendor directly.
  • Refunds are not automatic. Cancelling a booking on the site releases your place; it does not by itself return your money. Refunds are assessed against the cancellation policy for that tour and processed manually. Allow up to 10 business days for an approved refund to appear on your statement.
  • Past bookings cannot be cancelled on the site, and no-shows are not refundable unless the vendor policy says otherwise.
  • Repeat cancellations are limited. Vendors can cap how many times one person may book and then cancel the same tour (by default 3 times). Once you reach the cap you cannot book that tour again.
  • If the vendor cancels — including for weather, safety or minimum numbers — you are entitled to a full refund of what you paid.

Nothing here removes rights you have under consumer law in your own country. If those rights give you more than this section does, those rights apply.

6. Terms for vendors

These additional terms apply if you list experiences on Halum.

  • Verification. Your account must be approved before your tours become visible. You must give accurate business details and any documents we reasonably ask for. We may withdraw approval if they turn out to be inaccurate.
  • Accuracy. Listings must describe the experience truthfully, including duration, meeting point, what is included, physical demands and any age or health restrictions. Photographs must be of the actual experience or clearly representative of it, and you must hold the rights to use them.
  • Legality and safety. You are responsible for holding the licences, permits and insurance your activity requires, and for operating safely and lawfully.
  • Commission. We deduct a commission from each completed booking — 15% unless we have agreed a different rate with you in writing. The rate applying to your account is shown in your vendor dashboard.
  • Payouts. We pay out the balance after commission to the payout details on your account. You are responsible for your own taxes.
  • Honouring bookings. You must honour confirmed bookings. If you have to cancel, tell the traveller as early as you can; they are entitled to a full refund.
  • Customer data. Traveller details we pass to you may be used only to deliver that booking. You must not add those travellers to marketing lists, sell their details, or keep them longer than you need.

7. Partner links and QR codes

Vendors can generate tracking links and QR codes to give to hotels, guides and other partners, and pay them commission on the business they bring. If you create or distribute those links:

  • Attribution works on a last-click basis and lasts 30 days from the click.
  • Do not inflate the numbers. Automated clicking, paid click traffic, clicking your own links, or any other artificial activity is prohibited. We filter automated traffic and count repeat clicks from the same visitor once within a short window.
  • Do not present a partner link as an official Halum communication, use it in unsolicited bulk email, or place it on sites containing illegal or adult content.
  • We may void statistics and withhold the commission attached to them where we reasonably believe activity is artificial.
  • Commission arrangements with partners are between the vendor and the partner. We provide the tracking; we are not a party to that arrangement and do not pay the partner.

8. Reviews and other content you post

You can review a tour you have booked. Reviews must be your own honest experience. Do not post anything false, abusive, discriminatory, or that identifies other people without their agreement; do not post a review in exchange for payment, and do not review your own tours.

You keep ownership of what you post. You give us a non-exclusive, worldwide, royalty-free licence to display, reproduce and distribute it in connection with running and promoting the service. We may remove content that breaks these rules, and we will remove a review if you ask us to.

9. Acceptable use

You must not:

  • use the service for anything unlawful, or to defraud anyone;
  • interfere with the site, probe or bypass its security, or try to access accounts or data that are not yours;
  • scrape, harvest or bulk-copy listings, reviews or user information;
  • impersonate anyone, or misrepresent your connection with a business; or
  • place bookings you do not intend to honour.

10. Intellectual property

The Halum name, logo, site design and software belong to us and are protected by intellectual property law. You may use the site for its intended purpose; that does not give you any right to our brand or code. Listing content belongs to the vendor who posted it.

11. Disclaimers

We provide the platform with reasonable care and skill, but we do not promise it will always be uninterrupted or error-free, and we may change or suspend features.

Listings are written by vendors. We check vendors before approving them, but we do not independently verify every claim in every listing, and we do not warrant the quality, safety or legality of any experience. Maps and place data are supplied by third parties and are for guidance only.

12. Liability

Nothing in these terms limits liability that cannot be limited by law — including liability for death or personal injury caused by negligence, or for fraud.

Subject to that, we are not liable for the acts or omissions of a vendor, for anything that happens during an experience, or for indirect or consequential loss such as lost profit, lost data, or the cost of travel and accommodation booked around a tour. Our total liability to you for any claim connected with a booking is limited to the amount you paid for that booking.

If a vendor causes you loss, we will give you the information you reasonably need to pursue it with them.

13. Indemnity

If you are a vendor or a partner, you agree to cover us against claims, losses and reasonable costs arising from your listings, your conduct of an experience, your use of partner links, or your breach of these terms.

14. Suspension and closing your account

You can close your account at any time. We may suspend or close an account that breaches these terms, that we reasonably believe is being used fraudulently, or where we are required to by law. Where it is reasonable to do so we will tell you first and give you a chance to put things right.

Closing an account does not cancel confirmed bookings, and does not affect obligations already incurred. Sections 10 to 13 survive.

15. Changes to these terms

We may update these terms as the service develops. The date at the top always reflects the current version. If a change materially affects your rights we will give you notice by email or on the site before it takes effect. The terms in force when you make a booking are the ones that apply to it.

16. Governing law and disputes

These terms are governed by the law of the State of Wyoming, United States, whose courts have jurisdiction over any dispute. If you are a consumer, this does not deprive you of the protection of the mandatory law of the country where you live.
